Acceptable Use Policy

Introduction

This Acceptable Use Policy (AUP) outlines the appropriate and acceptable uses of Vendor Technology (as defined in the Agreement) and related services (the "Services") and website.

By using our Services, you agree to the latest version of this AUP. We reserve the right to modify this AUP at any time. You agree to use the service in a lawful manner and for its intended purposes. You agree not to engage in any activity that could harm the Vendor service or its users, or that could interfere with the functioning of the service.

This AUP is incorporated by reference into, and forms part of, the Master Services Agreement between Vendor and Company (the "Agreement"), available at tekst.com/legal/terms-conditions. In the event of any conflict between this AUP and the Agreement, the Agreement shall prevail.

Capitalized terms used but not defined in this AUP have the meaning given to them in the Agreement.

Prohibited Conduct

The following conduct is expressly prohibited on Vendor:

  • Using Vendor to infringe on the rights of others, including intellectual property rights.
  • Uploading or transmitting malicious code, viruses, or other harmful software.
  • Engaging in spamming, phishing, or other fraudulent activities.
  • Harassing or threatening other users of the service.
  • Impersonating Vendor or another user of the service.
  • Using Vendor for any illegal or unauthorized purpose.
  • Engaging in any activity that violates any applicable law, regulation, or third-party rights.
  • Distributing malware or viruses.
  • Hacking or attempting to gain unauthorized access to our systems.

Misuse of AI Core

Vendor's AI core is designed to automate manual responses and tasks. Misuse of the AI core can lead to false positives, inappropriate responses, or other issues that can negatively impact our users. Therefore, you may not use the AI core to:

  • Engage in any activity that violates any applicable law, regulation, or third-party rights.
  • Harass, threaten, or intimidate anyone.
  • Discriminate against anyone based on race, gender, religion, or any other characteristic.
  • Spread hate speech or promote violence.
  • Engage in any activity that violates the Agreement or this Acceptable Use Policy.

User Content

Any content that you upload or transmit on Vendor is your responsibility. You agree that you will not upload or transmit any content that is illegal, offensive, or otherwise objectionable. Vendor reserves the right to remove any content that violates this policy or that we believe is harmful to the service or its users.

Intellectual Property

Vendor respects the intellectual property rights of others, and we ask that you do the same. You agree not to use any content of Vendor in a way that infringes on the intellectual property rights of others.

Enforcement

Your access to the Services may be suspended in accordance with Section 9 (Suspension) of the Agreement, or terminated in accordance with Section 8 (Termination) of the Agreement, upon a violation of this policy.

We reserve the right to investigate any violation or misuse of our Services.

Reporting

If you become aware of any violation of this policy, you will immediately notify us and provide us with assistance, as requested, to stop or remedy the violation.

Amendments

We may revise and update this AUP from time to time by posting the updated policy on our website, notwithstanding Section 21 (Modifications, Waiver) of the Agreement. By continuing to use our Services after any changes come into effect, you agree to the revised policy. If a revision materially reduces your rights, we will provide reasonable advance notice where practicable.
